Privacy Policy

Healthy Bitch Daily (“HBD”) respects the privacy of its users whether they use the healthybitchdaily.com website (the “site”) to participate in interactive programs or simply view the site.  The following privacy policy (the “Policy”) is designed to inform you as a user of the site about the types of information that HBD may gather about or collect from you in connection with your use of the site.  It also is intended to explain the conditions under which HBD uses and discloses that information, and your rights in relation to that information.

Changes to this Policy are discussed at the end of this document.  Each time you use the site, however, the current version of the Policy will apply.  Accordingly, each time you use the site you should check the date of the Policy (which appears at the end of this document) and review any changes since the last time you used the site.

1. Children: This site is not intended for minors under 18 years of age.  HBD does not knowingly collect personal information from minors under 18.

2. Gathering, Use and Disclosure of Non-Personally Identifying Information

“Non-Personally Identifying Information” is information that, without the aid of additional information, cannot be associated directly with a specific person.

“Personally Identifying Information” is information, such as a name or email address that, without more, can be directly associated with a specific person.

Like most website operators, HBD gathers from users of the site Non-Personally Identifying Information of the sort that web browsers, depending on their settings, may make available.  That information includes the user’s Internet Protocol (“IP”) address, operating system and browser type, and the locations of the web pages the user views right before arriving at, while navigating, and immediately after leaving the site.

HBD analyzes Non-Personally Identifying Information gathered from users of the site to help HBD better understand how the site is being used.  By identifying patterns and trends in usage, HBD is better able to design the site to improve users’ experiences.  From time to time, HBD may also release the Non-Personally Identifying Information gathered from site users in the aggregate, such as by publishing a report on trends in the usage of the site.

3. Web Cookies

HBD also uses “cookies” to collect information. A cookie is a small data file that most major websites write to your hard drive for record keeping purposes when you visit them. Cookies allow HBD to measure activity on our website to improve your user experience by, for example, remembering your passwords and/or viewing preferences. Cookies are used by HBD  to measure activity on our site to make improvements and updates based on which areas are popular and which are not. We do not use cookies to retrieve information from your computer that was not originally sent in a cookie. Except for personal information voluntarily provided by you (i.e., during membership registration), HBD does not use information transferred through cookies for any promotional or marketing purposes, nor is that information shared with any third parties whatsoever.  Most browsers are initially set to accept cookies. If you prefer, you can set your browser to refuse cookies or to alert you when cookies are being sent. However, it is possible that some parts of our site will not function properly if you do so.

4. Collection, Use and Disclosure of Personally-Identifying Information (“PII”)

As defined above, PII is information that can be directly associated with a specific person.  In order to supply you with your HBD email, HBD collects your email address. HBD may also request other information such as your age, the city and state in which you reside and your profession.

Users of the site are under no obligation to provide HBD with PII of any kind, with the caveat that a user’s refusal to do so may prevent the user from using certain site features.

BY REGISTERING WITH THE SITE, YOU CONSENT TO THE USE AND DISCLOSURE OF YOUR PII AS DESCRIBED IN THIS “COLLECTION, USE AND DISCLOSURE OF PERSONALLY IDENTIFYING INFORMATION” SECTION.

Users may, at their option, disclose their own PII by any means they choose.  USERS ASSUME ALL RESPONSIBILITY FOR ANY LOSS OF PRIVACY OR OTHER HARM RESULTING FROM THEIR VOLUNTARY DISCLOSURE OF PII.

HBD will disclose PII under the following circumstances:

a.              By Law or to Protect Rights.  HBD discloses PII when required to do so by law, or in response to subpoena or court order, or when HBD believes in its sole discretion that disclosure is reasonably necessary to protect the property or rights of HBD, third parties, or the public at large.

b.              Marketing Communications.  If users opt in to receive HBD marketing materials upon registration, HBD will email users about products and services that HBD believes may be of interest to them.  HBD will also provide users’ email information to third parties so that those third parties may directly contact users about additional products and services.  If a user wishes to opt out of having their email information provided to third parties at any time after registration, they may do so by sending HBD an email at info@healthybitchdaily.com.  Even after opting out, a user may continue to receive marketing emails from third parties to whom HBD already has provided the user’s email information.  Users will be responsible for directly contacting such third parties to request cessation of further marketing emails.

c.              Business Transfers; Bankruptcy.  HBD reserves the right to transfer all PII in its possession to a successor organization in the event of a merger, acquisition, or bankruptcy or other sale of all or a portion of HBD’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred PII will be subject to this Policy, or to a new privacy policy if you are given notice of that new privacy policy and are given an opportunity to affirmatively opt out of it.

5. Email to Friends Feature and Referral Program

HBD offers users the ability to send friends emails about the site.  If users choose to use this feature, be assured that HBD only uses friends’ email addresses on a one-time basis to send the requested email.

6. Collection and Use of Information by Third Parties

HBD contractually prohibits its contractors, affiliates, vendors, and suppliers from disclosing PII received from HBD, other than in accordance with this Policy.  Third parties are under no obligation to comply with this Policy, however, with respect to PII that users provide directly to those third parties, or that those third parties collect for themselves.  HBD neither owns nor controls third-party websites accessible through the site.  Thus, this Policy does not apply to information provided to or gathered by the third parties that operate them.

7. Privacy Policy Changes

HBD may, in its sole discretion, change this Policy from time to time.  Any and all changes to this Policy will also be reflected on this page.  Unless HBD obtains your express consent, any revised privacy policy will apply only to information collected after such time as the revised privacy policy takes effect, and not to information collected under any earlier privacy policies.  HBD encourages users to frequently check this page for any changes to its Policy.
